Delaware publishes its own official family law forms, filing instructions, and self-help materials, but they are spread across several government sites. Delaware's core family statutes live in the Delaware Code Title 13 - Domestic Relations. File in person or by mail with the Family Court clerk in New Castle, Kent, or Sussex County.

How the Delaware court system handles family cases

Family cases in Delaware are heard in the Family Court. Delaware has a single, dedicated statewide Family Court for all divorce, custody, and support.

Family Court sits in each of Delaware's three counties.

Delaware's highest court is the Delaware Supreme Court. This state has no middle appeals court - appeals go straight to the top court.

Besides the judge, a Commissioner may handle parts of a family case. Family Court Commissioners hear support and many other matters alongside the judges.

Delaware is one of the few states with a true statewide Family Court - you do not file in a general 'circuit' or 'district' court.
