Idaho publishes its own official family law forms, filing instructions, and self-help materials, but they are spread across several government sites. This page organizes the official Idaho sources in one place so you can go straight to the right court page for forms, e-filing, rules, and locations.
Idaho's core family statutes live in the Idaho Code Title 32 - Domestic Relations. If you choose to e-file in your case you are expected to keep e-filing for the rest of it unless the judge lets you switch back to paper.
How the Idaho court system handles family cases
Family cases in Idaho are heard in the District Court, usually in the Magistrate Division. In Idaho, divorce and custody are usually heard in the Magistrate Division of the District Court.
Idaho's 44 counties are grouped into 7 judicial districts.
Appeals from a family case generally go first to the Court of Appeals, and the state's highest court is the Idaho Supreme Court.
Besides the judge, a Magistrate Judge may handle parts of a family case. Idaho magistrate judges - not the district judges - hear most family cases day to day.
Most Idaho family cases start in front of a Magistrate Judge, with appeals going up to a District Judge first.
