New Mexico publishes its own official family law forms, filing instructions, and self-help materials, but they are spread across several government sites. New Mexico's core family statutes live in the New Mexico Statutes Chapter 40 - Domestic Affairs. New Mexico does offer self-represented e-filing, but only for magistrate and metropolitan courts, which do not handle family law.

How the New Mexico court system handles family cases

Family cases in New Mexico are heard in the District Court. Divorce and custody are heard in the District Court.

New Mexico's 33 counties are grouped into 13 judicial districts.

Appeals from a family case generally go first to the New Mexico Court of Appeals, and the state's highest court is the New Mexico Supreme Court.

Besides the judge, a Magistrate / Commissioner may handle parts of a family case. Besides the judge, a magistrate, commissioner, or referee may hear temporary orders, child support, and uncontested matters - usually subject to a judge's review.
