How the North Carolina court system handles family cases

Family cases in North Carolina are heard in the District Court. In North Carolina, divorce, custody, and support are heard in the District Court (not Superior Court).

North Carolina's 100 counties are grouped into judicial districts.

Appeals from a family case generally go first to the North Carolina Court of Appeals, and the state's highest court is the North Carolina Supreme Court.

Besides the judge, a Magistrate / Commissioner may handle parts of a family case. Besides the judge, a magistrate, commissioner, or referee may hear temporary orders, child support, and uncontested matters - usually subject to a judge's review.
