West Virginia's core family statutes live in the West Virginia Code Chapter 48 - Domestic Relations. Free fill-in divorce packets are on the courtswv.gov website, and the circuit clerk's office accepts them in person or by mail.

How the West Virginia court system handles family cases

Family cases in West Virginia are heard in the Family Court. West Virginia has a dedicated Family Court for divorce, custody, and support; Circuit Court handles appeals and some related matters.

West Virginia's counties are grouped into family court circuits.

Appeals from a family case generally go first to the Intermediate Court of Appeals, and the state's highest court is the Supreme Court of Appeals of West Virginia. Created in 2022; family appeals now route through it.

Besides the judge, a Magistrate / Commissioner may handle parts of a family case. Besides the judge, a magistrate, commissioner, or referee may hear temporary orders, child support, and uncontested matters - usually subject to a judge's review.

West Virginia has a dedicated Family Court, but appeals first go to the Circuit Court, then up the ladder.
